An Act to amend and consolidate the law relating to the regulation and inspection of mines

Whereas, it is expedient to amend and consolidate the law relating to the regulation and inspection of mines; This Act may be called the Mines Act, 1923. It extends to the whole of Pakistan.

THE PAYMENT OF WAGES ACT, 1936 (IV OF 1936)

An Act to regulate the payment of wages to certain classes of persons employed in industry. it is expedient to regulate the payment of wages to certain classes of persons employed in industry; Short title, extent, commencement and application. This Act may be called the Payment of Wages Act, 1936. It extends to the whole of the Punjab. It shall come into force on such date as the  Government may, by notification in the Official Gazette, appoint. It applies to the payment of wages to persons employed in any factory 10[industrial establishment or commercial establishment] and to persons employed (otherwise than in a factory) upon any railway by a railway administration or, either directly or through a sub-contractor, by a person fulfilling a contract with a railway administration. THE REGULATION OF MINES AND OIL-FIELDS AND MINERAL DEVELOPMENT (GOVERNMENT CONTROL) 1948

An Act to make provision for certain matters connected with the regulation of mines and oil-fields and mineral development. WHEREAS it is expedient to make provision for certain matters connected with the regulation of mines and oil –fields and minerals developments under government control;  it appears to the Central Government to be expedient in the public interest to make such provision to the extent hereinafter appearing; It is hereby enacted as follows: Short titles, extent and commencement. This Act may be called The Regulation of Mines and Oil fields and Mineral Development (Government 1Control) Act, 1948.  It extends to the whole of Pakistan. It shall come into force on such date5 as the Central Government may, by notification in the official Gazette, appoint in this behalf. 2. Power to make rules.- It is hereby declared to be expedient in the public interest that the appropriate Government shall have power to make 7 rules to provide for all or any of the following matters. THE COAL MINES (FIXATION OF RATES OF WAGES) ORDINANCE, 1960

That the ordinance is to provide for the fixation of rates of wages in respect of labour employed in coal mines and for matters connected therewith. It is expedient to provide for the fixation of rates of wages in respect of labour employed in coal mines and for matters connected therewith. in pursuance of the proclamation of the seventh day of October, 1958, and in exercise of all powers enabling him in that behalf, the President is pleased to make and promulgate the following Ordinance:– 1. Short title, extent and commencement. This Ordinance may be called the Coal Mines (Fixation of Rates of Wages) Ordinance, 1960. It extends to the whole of Pakistan. RULES

A. PUNJAB MINING CONCESSION RULES, 2002

In exercise of the powers conferred upon him under section 2 of the Regulation of Mines and Oil-fields and Mineral Development (Government Control) Act, 1948 (XXIV of 1948), the Governor of the Punjab is pleased to direct that the following rules shall be made.-
  1. Short title and commencement.- (1) These rules may be called the Punjab Mining Concession Rules, 2002.

B. COAL MINES REGULATIONS, 19261

(1) These regulations may be called the Coal Mines Regulations, 1926. (2) They shall apply only in respect of coal mines.
  1. In these regulations, unless there is anything repugnant in the subject or context:- “the Act,” means the Mines Act, 1923;
(b) “approved safety lamp,” ”approved flame safety lamp” and “approved electric torch” means, respectively, a safety lamp, a flame safety lamp or an electric torch manufactured by such firm and of such type as the Chief Inspector may from time to time specify by notification in the Gazette of Pakistan, and includes any other safety lamp or electric torch approved by the Chief Inspector by an order in writing; (c) “The District Magistrate,” in relation to any mine, means the district magistrate of the district in which the mine is situated; Provided that in the case of a mine which is situated partly in one district and partly in another, the District Magistrate for the purposes of these regulations shall be the District Magistrate authorized in this behalf by the appropriate Government; (d) “Form” means a form as set out in schedule1; (e) “Permitted explosive” means an explosive permitted by the Chief Inspector under such definition and subject to such conditions as he may from time to        time lay down by notification in the official Gazette; (f) “ventilating district” means such part of a mine as has an Independent intake airway commencing from a main intake airway, and an independent return airway terminating at a main return airway. C. PUNJAB COAL MINES RESCUE RULES, 19881

In exercise of the powers conferred under Section 30-A of the Mines Act, 1923, the Governor of the Punjab is pleased to make the Punjab Coal Mines Rescue Rules, Short title and commencement.- (1) These rules may be called the Punjab Coal Mines Rescue Rules, 1988. (2) They shall come into force with immediate effect.
  1. Extent.- They shall apply to the Coal Mines in the Province of the Punjab.
  2. Definitions.- In these rules unless there is anything repugnant in the subject or context:-
(a) “Act” means the Mines Act 1923. (b) “Chief Inspector” means the Chief Inspector of Mines Punjab. (c) “Committee” means the Rescue Station Committee constituted under Rule 4. (d) “Chairman” means the Chairman of the Committee. (e) “Excise Duty” means the duty levied on the despatch of coal from mines. (f) “Government” means the Government of the Punjab. (g) “Member” means a Member of the Committee. (h) “Rescue Station” means the Rescue Station(s) established under Rule 33 of these rules; and (i) “Schedule” means Schedule to these Rules. D. METALLIFEROUS MINES REGULATIONS, 1926

[Regulations framed in exercise of the powers conferred by Section 29 of the Mines Act.1923 (IV of 1923), after previous publication as required by sub-section (1) of Section 31 of the said Act.] Regulations for all mines except Coal Mines (1) these regulations may be called the Metalliferous Mines Regulations, 1926. (2) They shall apply to every mine of whatever description other than a coal or oil mine.
  1. In these regulations unless there is anything repugnant in the subject or context-(a) “The Act” means the Mines Act, 1923;
(b) “the District Magistrate”, in relation to any mine, means the District Magistrate of the district in which the mine is situated: Provided that in the case of a mine which is situated partly in one district and partly in another, the District Magistrate for the purposes of these regulations shall be the District Magistrate authorized in this behalf by the local Government. (c) “Form” means a Form as set out in the Schedule; (d) “Schedule” means the Schedule to these regulations.
